Today in Court, the Presiding Judge, upheld the petition of Michael Ankomah-Nimfah against the election of James Gyakye Quayson as a member of parliament for the Assin-North Constituency.
On behalf of the Petitioner, the lawyers prayed for four(4) declarations and two orders by the Court.
The Court granted Petitioner’s prayer to the effect that, the filing of nomination forms by James Gyakye to contest for MP at a time when he still held Canadian citizenship in addition to his Ghanaian citizenship was null and void.
Also, the subsequent clearance by the EC for James Gyakye to contest in the parliamentary elections of Assin-North during the 2020 elections was also null and void. James Gyakye Quayson’s election as MP is therefore of no effect as it was contrary to provisions of the Constitution, 1992, and the Representations of the people’s law.
Consequently, the Court has declared the election of James Gyakye as MP for Assin-North as being null and void.
The Court has also ordered re-election of the parliamentary elections in the Assin-North constituency and perpetually restrained James Gyakye from holding himself out as MP.
