NPP’s Matthew Nyindam stays in Parliament as Supreme Court quashes High Court ruling

The Supreme Court has quashed the decision of the High Court in Tamale that nullified the 2024 parliamentary election results for the Kpandai Constituency in the Northern Region.


The decision was taken by a majority of four to one, with Justice Gabriel Pwamang dissenting.
The apex court consequently set aside the November 24, 2025, judgment of the High Court in Tamale, together with all consequential actions and orders that arose from the decision.


This means the New Patriotic Party (NPP) candidate, Matthew Nyindam, gets to keep his seat, and there will be no by-election as was earlier announced by the Electoral Commission (EC )after the Speaker of Parliament declared the seat vacant following the Tamale High Court judgement.


The Supreme Court panel was formed by Justices Amadu Tanko, Yonny Kulendi, Samuel Asiedu, Henry Anthony Kwofie and Gabriel Pwamang.


The Supreme Court indicated that the full reasons for both the majority and minority decisions would be filed at the registry of the court on February 6, 2026.


The High Court in Tamale had earlier annulled the parliamentary election results for the Kpandai Constituency and ordered a fresh election.


Following the High Court’s judgement, the Electoral Commission announced preparations for a by-election after the Speaker of Parliament declared the Kpandai seat vacant.


Gary Nimako Marfo, Counsel for Mr Matthew Nyindam, the New Patriotic Party (NPP) Parliamentary Candidate, spoke with the press after the Supreme Court ruling.

Mr Mathew Nyindam also spoke with the media, expressing his thoughts on the ruling, which allows him to continue his role as the legally recognised MP.

South Dayi MP and a member of the NDC legal team, Rockson Dafeamekpor, said the legal battle is not over and assured party supporters they would consider the next step,s including a possible review application.
